ساختار حقوقی جمهوری اسلامی ایران بهگونهای طراحی شده است که برونداد آن هرگز در تعارض صریح با شرع و ارزشهای دینیِ خانواده نخواهد بود. در این میان، با قضاتی مواجه هستیم که تعهّد چندانی به ارزشهای دینیِ ما ندارند، برای مثال، جرمانگاریِ کشف حجاب یا ممنوعیت رابطه جنسی خارج از ازدواج را خلاف حقوق بشر قلمداد میکنند. این قضات در پوشش «کنشگری قضایی» سعی میکنند تا مانند یک فعال اجتماعی و با بهرهمندی از ظرفیتهایی مثل تفسیر، قانون را در عمل بازنویسی کنند. نگارنده در این مقاله استدلال میکند که کنشگری قضایی پدیدهای شوم و خطرناک است که میتواند ارزشهای دینی خانواده ایرانی را مورد تهدید جدی قرار دهد. دغدغۀ اصلی نگارنده این است که نشان دهد حتی از منظر تأملات حقوقی (بروندینی)، کنشگری قضایی فاقد هر نوع وجهه قانونی است. این ادعا در قالب چهار استدلال حقوقی به اثبات خواهد رسید: (1) و (2) کنشگری قضایی در تعارض با مسلمات قانون اساسی ازجمله تفکیک قوا و حاکمیت مبتنی بر دموکراسی است؛ (3) کنشگری قضایی موجب تشتت در آرای قضایی و درنتیجه بیثباتی قانون میشود، پدیدهای که بخشی از هویت قانون است؛ (4) همچنین باید توجه کرد که کنشگری قضایی در تعارض با خواسته و مقصود قانونگذاران است.
