Abstract
In the system of family issues and relations between spouses, rights have been defined for each spouse. One of the rights that is considered as an exclusive right for the spouse is the right to divorce, which is also confirmed by Shiite jurisprudence. The famous rule of “Divorce for the One Who Has been Taken for the Blood” is discussed here as one of the evidences for the exclusive right to divorce for the spouse. In the words of the Imamiyeh jurists, this interpretation is mentioned with terms such as "well-known" and "acceptable". However, these words do not appear in the verses of the Holy Quran and the Imamiyyah narration texts. Hence, in some popular narrations, similar expressions have been used, which of course do not have a valid document from the Shiite point of view. However, the content of this rule, which is the exclusive right of divorce for the husband against his wife, acknowledged by guardian and Islamic ruler, is provable through some religious evidence. The application of authority and linguistic evidence in the verses of the Quran as well as narrations such as Sahih Muhammad ibn Qays and Muhammad ibn Hemad, as well as the importunity of the religious scholars as evidence for the rule. The frequency of citations by the Imamiyyah jurists in various issues also indicates the acceptance of the content of the above interpretation; however, the problem of the possibility of an additional restriction has also been ruled out with the help of evidence.
