Abstract
The major concern of the present research is to study the jurisprudential decree of alimony or maintenance in favor of widow. With the aim of determining the source of alimony, a year following the death of husband and illuminating the kind of support according to Holy Quran, this research tries to illustrate the relationship between this verse and the two aforementioned points taking advantage of the 240th verse in The Cow chapters being considered as the only verse referring to this issue. In this regard, presenting various interpretations from this holy verse, the elements of its difference, the reasons of Islamic well-known intellectuals on the abrogation of the verse according to the maintenance- oddeh- verse - The Cow chapter, 234th verse or Marvarith verse –Women chapter, 21st verse- it has been concluded that the verse is not referred to the alimony in ignorant age with the time of one year. Moreover, the owners of this viewpoint have not firmly supported their claim related to one year maintenance of widow in the age of ignorance and the stated testament in “making testament for their wives, vasiyaton le azvajehem” is interpreted based on the common viewpoint among Shiite scientists that there is no inconsistency between making testament in favor of wife and her being inherited or the aim maybe the divine advice and order and regarding its being preferential, it is not imagined any incongruity between this verse and Mawarith verse. Accordingly, there is no reason for cancellation of the holy verse and it is recommended for husband to make testament concerning the expense for one year living of wife a long with the right of residence in his house. This testament is effective and operative according to the determined regulations and there is no reason for its abrogation.
