This is done to ensure the increase in women eligibility in the parliamentary election process. The fundamental question discusses how these quotas are formed in the constitutions of countries and how the provision of gender-based quotas for women is legally justified. It also addresses the points that can be criticized. Applying an analytical-descriptive method, this study, in a comparative approach, discusses and evaluates attitudes of both proponents and opponents on gender-based quotas and the way parliamentary seats are distributed to women in different electoral systems. In short, from the point of view of opposing attitudes, these quotas are contrary to the principle of equality, party rights, democracy and meritocracy. Support for women's political participation, positive discrimination, and human rights also reflect the advocates' point of view. The basic premise of this article, answering the main question, is that despite opposing approaches, gender-based quotas are now accepted in the constitutions of many countries to ensure women's political participation. در حقوق انتخابات پارلمانی برخی از کشورها، سازوکار سهمیه‌بندی جهت افزایش نقش مشارکت سیاسی زنان پیش‌بینی شده است. این امر در راستای تضمین افزایش انتخاب‌پذیری زنان در فرایند انتخابات پارلمانی صورت می‌گیرد. این پرسش اساسی مطرح است که در حقوق اساسی کشورها این سهمیه‌ها چگونه شکل گرفته و پیش‌بینی سهمیه‌های مبتنی بر جنسیت برای زنان از لحاظ حقوقی چگونه توجیه شده است. نیز چه انتقاداتی می‌توان بر آن وارد کرد. در این پژوهش کوشیده شده با روش تحلیلی - توصیفی، ضمن مطالعة تطبیقی سهمیه‌های مبتنی بر جنسیت و نحوة توزیع کرسی‌های پارلمانی به زنان در نظام‌های انتخاباتی گوناگون، رویکردهای مخالفان و موافقان و استدلال‌ها بحث و ارزیابی شود. به‌اجمال از دیدگاه رویکردهای مخالف این سهمیه‌ها بر خلاف اصل برابری، حقوق حزبی، دموکراسی و شایسته‌سالاری هستند. حمایت از حق مشارکت سیاسی زنان، تبعیض مثبت و حقوق بشر نیز بیانگر رویکرد مدافعان است. فرض اساسی این مقاله در پاسخ به پرسش اصلی بر این مبنا استوار است که با وجود رویکردهای مخالف، امروزه در حقوق اساسی بسیاری از کشورها به منظور تضمین مشارکت سیاسی زنان، سهمیه‌های مبتنی بر جنسیت پذیرفته شده است. https://www.jgfs.ir/article_144902_6a019821260511efa2adc3c3841c8241.pdf
